THE Supreme Court of the Union issued Notifications No 955/2023, 956/2023, 957/2023, 958/2023 and 959/2023 dated 27 October 2023 that judgement power and jurisdiction power over appeals and amendments for judgements, orders and decisions adopted by the IP Rights Court was empowered to the intellectual property court in accord with the Industrial Design Law which came into force from 31 October 2023 in accordance with the Notification No 217/2023 of the State Administration Council dated on 18 October 2023 and Notification No 960/2023 on procedures of prosecution and jurisdiction under the Industrial Design Law.

  1. Under Section 66 (e) of the Industrial Designed Law under Notification No 955/2023, the jurisdiction power of the IP Rights Court was empowered to the Yangon Region High Court to jurisdicate applications over the decisions of the agency under Section 65 of the Industrial Design Law.
  2. Under Section 66 (c) of the Industrial Designed Law under Notification No 956/2023, the original criminal judgement power of the IP Rights Court was empowered to the following courts to exercise jurisdiction over criminal cases under that law: -
  1. Self-Administered Division Court
  2. Self-Administered Zone Courts
  3. District Courts
  1. Under Section 66 (d) of the Industrial Designed Law under Notification No 957/2023, Region and State High Courts were empowered with judgement power to establish jurisdiction on criminal judgements, orders, appeals and amendments over the decisions adopted by the courts of Self-Administered Division and Zones and District Courts under the Industrial Design Law.
  2. Under Section 66 (c) of the Industrial Designed Law under Notification No 958/2023, the original criminal judgement power of the IP Rights Court was empowered to Kyauktada District Court to invoke jurisdiction on the following cases: -
  1. Civil prosecution over violating IP rights under the Industrial Design Law
  2. Applications to temporarily take action under Section 67 (a) of the Industrial Design Law
  1. Under Section 66 (d) of the Industrial Designed Law as per Notification No 959/2023, the Yangon Region High Court was empowered to jurisdicate appeal and amendment cases over judgements, orders and decisions adopted by the IP Rights Court.
  2. The Supreme Court of the Union issued the procedures for jurisdiction over prosecutions under the Industrial Design Law by exercising the authority employed under Section 86(a) of the Industrial Designed Law as per Notification No 960/2023.
