THE State Administration Council enacted this law under Section 419 of the Constitution of the Republic of the Union of Myanmar.
1. This law shall be called the Law Amending the National Education Law.
2. In Section 2 of the National Education Law
(a) Sub-Section (c) shall be substituted as follows: -
“(c) Commission means the National Education Commission formed under Section 5 of this law.”
(b) The word “the National Education Policy Commission” mentioned in Sub-Section (s) shall be substituted with the word “the ministry or relevant ministry.
(c) Sub-Sections (z) and (zf) shall be substituted as follows:-
“(z) the National Education Standard and Qualification Guarantee Assessment Committee” means the organization formed with relevant experts by the ministry for assessing the education types and qualification guarantee of different education levels.
(zf) the University Council means the council formed with rectors, pro-rectors and those at same levels, chiefs of faculties, deans, subjectwise professors and management and financial officials of relevant universities under the charters of relevant universities.”
(d) Sub-Section (aa) shall be added after the Sub-Section (zg) as follows:-
“(aa) the National Education Standard Framework means the framework drawn by the National Education Standard and Qualification Guarantee Assessment Committee and approved by the ministry in order to set the quality guarantee and qualification standard of all education levels.”
3. Section 4 of the National Education Law
(a) Sub-Section (b) shall be substituted as follows: -
“(b) the ministry and relevant ministries to seek advice from experts and the people in drawing the laws related to education
(b) Sub-Section (c) shall be nullified.
(c) Sub-Section (j) shall be substituted as follows:-
“(j) universities, degree colleges, colleges and institutes to lead independent management system in accord with the education policies
(d) The word “education standard” mentioned in Sub-Section (o) shall be substituted with the word “the education standard in accord with the national education level framework”.
4. In Chapter IV of the National Education Law
(a) the title shall be substituted as follows: -
“Formation of National Education Commission and its duties and obligations”
(b) Sections 5 and 6 shall be substituted as follows: -
“5. (a) the government shall constitute the National Education Commission as follows:-
(1) An expert chosen by the government 1
(2) An expert chosen by the ministry 1
(3) An expert from basic education sector 1
(4) An expert from higher education sector 1
(5) An expert from technical and vocational sector 1
(6) An expert from teacher education sector 1
(7) An expert from all-inclusive education sector 1
(8) An expert from curriculum 1
(9) Legal expert 1
(10) A representative from the ministry 1
(b) The chairman of the commission shall be elected by commission members.
(c) The duties of the secretary and the joint secretary of the commission shall be assigned to representatives from the ministry.
(d) The government shall amend the formation of the commission if necessary.
(e) The term of the commission shall be five years as usual.
